How to Lodge a Complaint?

To lodge a complaint with the Commission, there are 3 ways you can do this:

1. Call in personally at the Commission and speak to an Investigations Officer;

2. Write in with the full details of your complaint and your contact details to:

Suva.

What then happens to my complaint?

Once you have lodged your complaint with us we do the following:

1. Study your complaint properly so that we can advise you about what can be done next.

2. Direct you to another agency if your grievence is not within our jurisdiction.

3. Investigate your complaint privately and confidentially.

4. Try to resolve your grievance through a conciliation meeting or begin civil proceedings. This could mean:

  • compensation for you;

  • a promise that the incident complained of will not re-occur;

  • a High Court Declaration that your rights were violated;

  • a High Court Order that the person or organisation complained of does something or refrains from doing something;

  • a High Court Order that the Respondent pay you damages.

 

Who deals with my complaint?

The Fiji Human Rights Commission's personnel are all professionals.

Your complaint is first of all dealt with by our Complaints team, which consists of qualified and experienced investigative officers and lawyers.

The Commission has a Proceedings Commissioner who has been given the responsibility by law to take all complaints through conciliation procedures and if necessary, to the courts.

It is important to note that the Commission can only assist you in your complaints of allegations of breaches of human rights and/or unfair discrimination. It is therefore to your advantage that you understand more about the area's of human rights that the Commission has jurisdiction over.
